By engaging Buildify ("Company," "we," "us," or "our") for any marketing, lead generation, or sales services, you ("Client") agree to be bound by these Terms and Conditions. Please read them carefully before proceeding.
Buildify provides marketing and business growth services including, but not limited to, website design and development, lead generation campaigns, paid advertising management, sales funnel development, and client acquisition strategy. The specific scope of services for each engagement is outlined in a separate Service Agreement or Statement of Work.
The Client agrees to:
Fees for services are outlined in the applicable Service Agreement. Invoices are due within the timeframe specified. Late payments may result in suspension of services. All fees are non-refundable unless otherwise stated in writing.
Upon full payment of all fees, the Client receives a licence to use deliverables produced specifically for them. Buildify retains ownership of all proprietary tools, templates, methodologies, and pre-existing intellectual property used in delivering the services. Buildify reserves the right to display completed work in its portfolio unless the Client requests otherwise in writing.
Both parties agree to keep confidential any proprietary or sensitive information shared during the engagement and not to disclose such information to third parties without prior written consent, except as required by law.
Buildify uses industry best practices and data-driven strategies to maximise results. However, we do not guarantee specific outcomes such as a defined number of leads, a particular revenue figure, or a specific return on advertising spend, as results depend on factors outside our control including market conditions, client follow-up, and advertising platform performance.
To the fullest extent permitted by law, Buildify shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the use of our services. Our total liability shall not exceed the fees paid by the Client in the three months preceding the claim.
Either party may terminate a service engagement by providing written notice as specified in the applicable Service Agreement. Upon termination, the Client shall pay for all services rendered up to the termination date. Buildify reserves the right to terminate immediately for non-payment or breach of these Terms.

These Terms are governed by and construed in accordance with applicable law. Any disputes shall be resolved through good-faith negotiation before pursuing formal legal proceedings.
We reserve the right to update these Terms at any time. Continued use of our services after changes are posted constitutes acceptance of the revised Terms.
